AI Vision is committed to protecting your privacy and strictly limits the scope of data processing to that which is technically necessary to provide the service. Your use of the virtual try-on solution provided by AI Vision (including its optional additional services, collectively referred to as the "Service"), whether or not the Service is available on this website or application, is subject to the following data privacy policy (the "Policy"), which includes a class action waiver and jury trial waiver for end users located in the United States.
When you access or use the Services, you acknowledge that you have read and reviewed the terms of this Policy and agree to them in full, including the Class Action Waiver and Jury Trial Waiver if you are located in the United States.
When you access or use the Services, you authorize AI Vision to use your webcam solely for the purpose of providing the Services, and this authorization will continue for as long as you use the Services.
When you access or use the Services, you certify that you have full legal capacity, meaning that you have reached the age of majority in your jurisdiction, have the legal capacity to enter into these Terms as an adult, or have obtained appropriate parental or guardian consent.
If you are a minor or have restricted conduct, or if you do not agree or no longer agree in the future to this Policy and/or any amendments thereto, please do not use the Services.
Please note that this Disclaimer constitutes a notice regarding biometric identifiers and applies to residents of the United States, including but not limited to residents of Illinois and Colorado.
1. Scope of application of the policy
This Policy applies to any personal or biometric information that may be processed, collected, or hosted when you use the Services ("your Personal Data").
This Policy does not apply to data that cannot be associated with you or used to directly or indirectly identify you, including anonymized, de-identified, or aggregated data.
2. How does the AI Vision virtual try-on solution work?
When you use the Services, AI Vision may detect, capture, and/or change the appearance of your face.
The service estimates a standard 3D face based solely on standard mathematical points found on every face to ensure proper fit and positioning, allowing you to virtually see the digital product you are trying on.
The estimation of mathematical facial landmarks does not allow for personal identification or authentication. These landmarks are not unique to a specific person and are not stored or compared against any dataset or reference. Your image is processed instantaneously (i.e., almost instantaneously), stripped of any identifiable data, and automatically discarded with no persistent data.
While your image may be considered personal data or a biometric identifier under certain regulations, your image is processed in a way that does not identify you (de-identified, meaning no identifiers or information that could identify you are removed) for this service. It is used only during the virtual try-on experience and is then automatically deleted from our servers. AI Vision does not retain or disclose your image.
3. What the Virtual Try-On Solution Does Not Do
No Identification: AI Vision cannot directly or indirectly identify you through the Services.
No biometric processing: Our technology is not a biometric system, nor is it facial recognition or facial authentication technology; when an end user's face is detected, no facial recognition or similar biometric collection or processing is performed.
The data we collect is generated through technical processing, measurement, and analysis of your face using standard mathematical markers. Similar technologies may calculate your unique physical or physiological characteristics that could be used to uniquely identify you, but we do not use them for this purpose (it is not "your personal data"). This means that while this data may be considered a "biometric identifier" under certain regulations (if further processed to identify you), it is not "biometric data" (data used to identify you) because we do not further process it to identify you.
Our technology is not used for user profiling or identifying gender, age, or ethnicity, nor is it used to authenticate your identity.
Our technology is not used for profiling purposes: Our services do not categorize you based on your biometric data (such as age, hair color, eye color, tattoos, behavior or personality traits), nor can they infer your race, political affiliation, trade union membership, religious or philosophical beliefs, sex life or sexual orientation.
Our technology is not an emotion recognition system: the Service cannot identify or infer your emotions or intentions.
The Services do not rely on automated decision-making.
No data aggregation or subsequent processing: No personal data will be combined with your images or de-identified or anonymized data required for service processing. AI Vision does not collect data about your browsing behavior or IP address.
AI Vision does not perform any additional or subsequent processing of your images; AI Vision does not use your images or personal data for any purpose other than providing services.
4. Not Selling or Disclosing
AI Vision does not sell, distribute, rent, trade, disclose, or disseminate any user images or personal data (including your personal data).
5. Legal Basis and Retention
The processing of your images and, if applicable, your personal data is necessary for the provision of the services (Art. 6 para. 1 lit. b GDPR).
Your images are processed only during the virtual try-on experience and are then automatically deleted from our servers (temporarily). If you save a screenshot of your try-on, it will only be saved on your device.
If any personal data is accidentally obtained, AI Vision will permanently delete it within 30 days or once the original purpose has been fulfilled.
6. About UUID and Cookies
We use UUIDs to track session occurrences and aggregate them for statistical purposes and vendor invoicing (you are not our professional client, and we do not charge you). A UUID is a "digital fingerprint" that uniquely identifies a user (in this case, AI Vision's professional client) through a randomly generated 128-bit value. Unlike cookies, which may contain personal information, a UUID does not contain personal information, and the UUID alone cannot be used to identify you. This data may be shared with vendors and retained for five years to comply with legal and regulatory requirements.
The Service may store cookies that are strictly necessary only for the operation of the virtual try-on technology.
AI Vision does not use any marketing or tracking cookies. AI Vision does not have access to the content, information, and data on your device. You are responsible for their security.
Please note that third parties (including professionals operating services, websites or applications) may collect and/or store data or cookies locally.
You can refuse, disable or delete cookies through your browser settings. However, please note that this may affect the functionality of the Services, Website or your device.
7. Our Services Do Not Provide Medical Advice, Diagnosis, or Treatment
Please note that this Service is for informational purposes only and does not constitute medical advice, diagnosis, or treatment. Therefore, the information and other content provided through this Service is not a substitute for professional medical advice, diagnosis, or treatment. If you currently or in the future require medical assistance, please contact a healthcare professional.
8. We are not responsible for the security policies, privacy policies and practices of third parties
This Policy does not apply to, and AI Vision is not responsible for, the collection, use, sharing, dissemination or processing of your personal information (including images or personal data) by third-party websites, applications and/or services, regardless of whether such websites, applications and/or services implement the Services or are accessed through the Services.
Likewise, AI Vision is not responsible for the handling of security incidents by the aforementioned third parties, nor is it responsible for whether they appropriately and accurately implement and display this policy, or provide you and other data subjects with information, disclaimers, or notices required by data protection, privacy, and security laws and regulations.
9. Incident Management
While we have implemented appropriate technical and organizational measures to protect data security using industry standards, no data transmission can be guaranteed to be 100% secure. We have protocols in place to respond to data security incidents, including notifying relevant personnel in the event of a personal data breach. However, since we cannot identify you and do not retain your personal data, such security incidents do not trigger any notification obligations to you.
10. Modifications to this Policy
AI Vision may unilaterally modify this Policy from time to time. Such modifications will be effective upon posting. You can review the most current version of this Policy by clicking the "Privacy Policy" button in the pop-up window that appears when you activate your webcam.
11. Class Action and Jury Trial Waiver (Applicable to End Users Located in the United States)
When you access or use the Services, and to the maximum extent permitted by applicable law, you irrevocably waive any right to a court or jury trial arising out of or related to your use of the Services. You further agree to bring lawsuits against AI Vision only in your individual capacity, and not as a plaintiff or member of a class, representative, or collective proceeding. Any arbitration will be conducted on an individual basis. Class arbitrations or class actions are not permitted. If the above class action waiver is held invalid or unenforceable, you and AI Vision each agree not to seek and waive any right to arbitrate, litigate, or otherwise resolve disputes on a class or collective basis.
This waiver applies only to users located in the United States and does not affect the rights of users located outside the United States, particularly in the European Union, where these provisions may be deemed unenforceable.
